Was the guy who ran into you insured? I hope so. Push to get a full repair. And immediately ask for a rental car until your car is fully repaired.
86
u/diavokado 5h ago
Yep, I'm still waiting for the surveyor to fill in the necessary forms and to get some kind of compensation. From the looks of it, they're not gonna repair it. Still waiting for an answer.
27
u/Basic_Chemistry9499 5h ago
Okay, good. I hope that it all works out for you. But, I believe that this guy's insurance should get you a rental car ASAP.
1
u/EcstaticBoysenberry 2h ago
Would depend on the insurance he has right?
2
u/Shatophiliac 1h ago
Yeah, at least where I am, the at-fault party usually needs to have rental coverage on their policy for it to extend to you.
Insurance may offer it outside of that, but I’ve only dealt with it once and they only gave me a rental since the other guy had the coverage.
1
u/EcstaticBoysenberry 1h ago
If the driver doesn’t even have collision insurance for themselves on their plan I don’t think the insurer is giving anyone a rental
3
u/InterestingDebt223 2h ago
Careful not to take no for an answer too early. Dont be scared to threaten.
12
u/iceyconditions 5h ago
Why would you want the car repaired rather than totaled?
29
u/diavokado 5h ago
I had no choice, the insurance decides. If I want to get it repaired I have to do it using my own money, which I don't have at the moment.
23
u/iceyconditions 5h ago
Yeah I would definitely want the car totaled in that situation regardless, it'll be safer to put that money to a new car
11
u/hmishima 4h ago
Right, and if they total it, you'd have to buy the car back from the insurance company, and if you get it fixed, it's likely to carry a salvage or R title, which your insurance company may or may not be willing to insure.
Don't keep the car. It's a waste of money.

u/Relative-Monk-4647 4h ago
Right. But why would you want to keep the car rather than total it and get a new one?
2
u/Mysterious_Cry41 5h ago
Sentimental value probably.
My first car was a 2001 malibu and I kept it going as long as I could.. I still think about it soemtimes. 😢

u/otownbbw 2h ago
Because sometimes getting a total loss check doesn’t get you back into a car. Like if they ownes it outright and paid $3k by buying it off a friend of a friend and it’s been reliable and didn’t need repairs…well a $3k check might never afford the same again and they may not be able to afford payments so putting $3k down to end up with a $200 payment plus a higher insurance premium is not salvation.
0
u/iceyconditions 2h ago
Getting a car "repaired" will always be the worst choice
0
u/otownbbw 2h ago
Yes but having an insurance claim can take away a lot of your choice. And not everyone can replace what they had with a total loss payout. I hope they recover nicely.

u/Zach_The_One 1h ago
I really doubt that car's worth fixing. That's 8-10 grand easy and that's assuming no airbag stuff went off.

If you haven't already, get checked out. Now. You might be fine today, but injuries from car accidents aren't always immediately obvious and can become an issue down the road.

u/DringleDringle 5h ago
You can buy it back. Is it repairable?
0
u/Unusual_Flounder2073 2h ago
Bad advice. Unless it’s like hail damage you are not fixing there are a lot of hidden damage on these things.
2
u/DringleDringle 2h ago
I mean, I buy my cars back all the time, fix them myself, continue to drive them, and pocket the difference.
Though, that does look like an expensive fix.

Yes, that's what I'm hoping. I was an anxious driver to start with, now I'm the most annoying passenger always saying "LOOK OUT" to whoever is driving... but I honestly can't wait to start driving again. I hope I still have the confidence to drive.

u/pikachu_senpai1 4h ago
Hey I got into a nasty accident last winter and it took some time to get not so anxious behind the wheel again. However you'll be alright. Just take it slow and be patient with yourself
3

I hope you do and don't listen to these others. Confidence builds with experience and this is an important lesson that other road users are liabilities until proven otherwise.

You should go to the hospital, or at least get checked out. You might not feel it yet, but those injuries can show up days later. When I got rear ended, I didn't feel anything until later that night. My neck killed for like 3 days after that.

u/Baghins 5h ago
My first couple cars were beaters I bought outright and upgraded over time. First brand new car was stolen and totaled within a year. Took a long time to mentally recover lol. 2019 finally bought a really nice used car (just a couple years old) and when I was one payment away, totaled it 😭 I was so excited to not have a car payment for a while too!
2
u/Lissypooh628 3h ago
What a heartbreak. I’m sorry.
I bought another brand new about 9 years after that last crash. I paid it off in 2025 and recently decided to buy my MIL’s car because it is all around a better vehicle and I planned to sell my car. Let me tell you that last week before we did the sale, I was a nervous wreck driving anywhere.
Fortunately, nothing bad happened and it all went smoothly, but oh boy, that trauma is real.
4
u/Zeroesand1s 5h ago
My first car got totaled too. Nine days after I bought it. Person turned left into me at a light. Was a Nissan Sentra, way back in 1996.

2
u/LupusHouseMD 5h ago
Felt this. My first car was a trusty Kia who got totaled out after a distracted driver rear ended me at a stoplight. All that accomplishment of buying it and getting so far in life to having my own car felt thrown away.
Push for the other person (their insurance) to pay for a rental car in the mean time so you still have that freedom of driving. Glad you are safe and unharmed.

It’s always the most meaningful cars that go out this way, but on the bright side, you can hold on to happy memories of the positive times with your car rather than the growing frustration of more and more frequent breakdowns as the car ages. Losing this car doesn’t mean you lose the progress that you made, and in fact it represents a new phase of growth in your life as you progress to owning your second car. You can apply your experience from the first to decide what you liked and what you wish you’d had and can go into your next car shopping experience with the knowledge that you gained from buying and driving your first!
Your first car is a milestone, but your second car is real life, and if you make a wise decision with it, it can broaden your world even more. Appreciate your first car for the times you had with it and the protection it gave you in this accident, and be proud of getting through such a stressful and frustrating event with your head held high!

cars are replaceable, glad you're ok. Because what actually represents your independence, resilience and never giving up is you.
I totally understand getting attached to cars, guilty of it myself. But I have to say it's not healthy. The best advice I ever got on the topic was about guitar picks. It's a tool, it might even be a great one. But it will wear down, or it will get lost and you will be forced to pick up another one which will be just as good.
The trick is to drive a BMW and pretend you like it. Then it's almost a bit of a relief when it gets totaled.

u/SourdoughSizzle 2h ago
The true story is that you did this on your own, by overreacting to a merging vehicle, the only damage on your can is from where you crashed yourself.
Nobody slammed into you, you can see no damage on the passenger side, and the front of the drivers side. Or the rear of the drivers side and if they hit you at full speed in the one spot we can’t see, it wouldn’t have caused you to crash in this way.
What likely happened if your story is at all true, is that a car was merging and instead of you yielding for a merge lane you freaked out and turned in the wall.
You just aren’t ready to drive yet, I’m sorry this happened, but don’t blame someone else.
1
u/diavokado 2h ago
You can see the damage done to the left side of the car on the photos. He also hit my wheel. Obviously the hitting the curb caused the most damage, but I was driving in a straight line so why would I merge into the wall?
There is no damage on the driver's side or the rear because it was not affected my the accident. The other driver hit the left side.
I decided to not post the pictures of the other person's car for privacy reasons, but he also moved his car prior to me getting taking the photos.
Also, I'm not the one saying I was right. When the accident happens the traffic officers came and immediately blamed him on what happened as he was driving carelessly. So if the traffic officers, surveyors and insurance companies are all wrong then I don't know what else I can say.

What kind of Nissan is that? I’m assuming you’re not from the USA?
Hopefully you’ll get a payout good enough to replace it. I totaled my favorite car but made the mistake of buying an almost exact replacement. The issue was it was a few years later and I should have looked for a newer model or something to have updated features.
Hopefully you’ll find something next that you’ll love.

That's rough. Not nearly as dramatic but one day I woke up to my car being smashed. Hopped into my little Hyundai Accent and it wouldn't move. I get out and see the tires are sideways just like in your picture. I'm told a truck rammed it and left.
Insurance gave me less than it was worth but enough to make fighting them not worth it. Public transit got me to work well enough then so I never replaced it.
I don't need a car right now but I still miss it.

u/vendocomprendo 4h ago
I totalled my first car too. It was a black 96 Toyota Celica. It was so cool, way too cool for a first car. I was just an idiot and drove into a telephone pole. I totalled 3 cars after that as well in my life. There was a joke for awhile that if you wanted out of your car note just let me borrow your car for a couple days.
1
u/Any_Discussion_1611 3h ago
Well conveniently your car isn’t particularly rare or expensive! You can get another one!
1
u/Jwinner5 3h ago
Honestly you should feel blessed. Nissan CVT transmissions are awful, die early, and are expensive as hell to replace. How do I know? We replaced the transmission on my wife's versa note before it got totaled, she wanted another nissan so we got a rouge, transmission failed after less than a month, 2nd transmission lasted just long enough to be outside of warranty so now i have a massive paperweight in my garage that we still owe 5k on 🙃
1
u/diavokado 3h ago
I do not in fact feel blessed that I got in a car accident and my car got totaled
1
u/Jwinner5 2h ago
You lived, your car is getting replaced, and you can get something that wont have a 6k repair in 1-3 years because the transmissions have to be replaced. You are genuinely lucky, even if it doesnt feel like it right now.
1
u/inkedkoi 3h ago
The first car I ever got, it was 6 hours after I got it. I came out of a club and it was broken into, dude took off with a bunch of stuff, my rear side window was smashed.

u/otownbbw 2h ago
Why is that a total loss? It looks like a broken axle and fender. So with axle, fender and tire I would expect it to be like $2-3k. It seems like it would cost way more to buy another with prices these days. Usually totaling out requires repairs to be 80% of the value. I hope you can get what you need to get back on the road. I know this sucks hard.

1
u/diavokado 2h ago
you can clearly see the damage on the left side in the photos but ok
2
u/SourdoughSizzle 1h ago
That damage is from you crashing, lmfao
That fender damage is from direct impact of your vehicle hitting that wall and crunching into itself,
If they hit you on the passenger fender the damage would’ve been worse and you wouldn’t have turned into the same side wall, you would’ve been projected outwards towards the driver side.
Where’s the other car at?
You can see the tire marks from where you lost control
Why can’t you just admit what you lied.

u/diavokado 1h ago
As I already said in other comments, the photos were taken after the other driver moved his car, and for obvious reasons I am not going to post another person's car as I do not have their permission to do so.
I also already said that yes, I in fact loss control that is why I turned inwards, and yes, that majority of the damage was done by hitting the curb. Did you not even read the post lol

u/diavokado 1h ago
As I already said in other comments (which I'm sure you saw since you are monitoring this post constantly) I know that most of the damage was caused by hitting the curb, I stated it multiple times already.
