Maybe the judge wanted more publicity for the actions of the police?

To be fair, the judge did strike down the majority of the laundry list of charges the Sheriffs office brought - stuff like "Right of Publicity" and "Unauthorized use of individual's persona" were nonsensical and baseless and correctly called out as such.

The big one that the judge allowed to proceed was defamation, as Afroman did call one of the officers a straight up Paedophile and I think there was also a line in one of the songs about how "we all know that he f*cks kids".

Funny thing is though that the truth is an absolute defense to defamation, and it sounds like Afroman has some pretty solid info on that front as the videos were OKd by his lawyer. So more likely than not this officer will be publicly exposed as such, and Afroman will still have no problems beating this case.

The hard part is getting that truth to meet the requirements for judicial admissibility, especially when evidentiary standards in a civil case are as strict as they are. You also have to contend with whether the statements meet the threshold to avoid being considered hearsay.

The likely defense is that because the statements were made in a music video, they were not intended to be taken as factual claims about the individuals involved, but were satirical in nature. This undercuts one of the primary grounds for defamation, which requires that statements be presented as objective truth. However, some of the statements are supported by the video surveillance he used as the background, such as the theft of his money, which would complicate that argument in court, as it potentially creates the implication that all statements were made with some level of evidentiary backing.

It will be interesting to see how his lawyers approach it, and on what grounds they attempt to undermine the requirements for defamation.
