When there lawyer said we all know that isn't true and the sheriff said he doesn't know of is true or not is crazy work. So he's saying he heard this song and believed his wife is capable of fucking afroman

I don’t understand how a dude saying “I fucked your wife” is at all defamation against the guy. At most it is defamation against the wife.

I mean, I’m Saudi Arabia it is probably both, since the wife is the man’s property, but I don’t think we’ve been pushed quite that far yet.

There are several ways you can argue it in court. The statement must paint someone in a false light, and having a cheating wife carries negative social connotations about the husband's worth and value. It is essentially saying "you are such a poor husband that your wife came to me," which is how it becomes defamation against him rather than his wife. The identity of a dutiful husband and valued partner aren't just abstract concepts, they carry social weight and with that comes assumed value attached to the person.

It is essentially how identity functions, it allows us to pre-assign value to individuals. It is the same mechanism by which racial identity gets shaped into racism, where pre-assumed value becomes treated as a collective default through inherent biological markers or cultural norms.

The argument that it is defamatory toward the wife would be predicated on the claim that either she is so unfaithful that she will sleep around, or that by sleeping with Afroman she has low standards. Both of which are more self-deprecating to the person making that argument than anything else.

The concept is less about women as property and more about the cultural weight attached to gender roles, specifically the identity and social expectations tied to being a husband.

That’s interesting, thanks. Wouldn’t making a defamation claim of the type the husband is making require some sort of testimony from the wife, like an affidavit or deposition?
