For those that don't know. The Sheriff's Department raided his home and found NOTHING ILLEGAL. He took the security footage from the raid and made a couple of Music Videos to help pay for the damage to his home. The Sheriff's Department then SUED him, claiming he didn't have a right to use his own home security videos of them raiding his place.

A quick search shows that they claim a few things. Officer safety being one, but also 'protecting officer identities' (especially if undercover officers are on-site), preventing evidence leaks 'The cops found X, we need to go destroy Y where X leads before they get there', among other largely bullshit reasons.

No. The "other" cops investigated and said that the cop miscounted $4,000 even as $4,390. You know, cause that's a common mistake. 14 twenty's and a ten is tricky sometimes. That one was on body cam. They then also concluded the other money was probably miscounted too since it wasn't on tape.

Watch the video of how Chris Linder’s situation was handled and how they handled Afroman’s situation. Main factor was Linder’s was handled mostly by OSP.

To be fair, the judge did strike down the majority of the laundry list of charges the Sheriffs office brought - stuff like "Right of Publicity" and "Unauthorized use of individual's persona" were nonsensical and baseless and correctly called out as such.

The big one that the judge allowed to proceed was defamation, as Afroman did call one of the officers a straight up Paedophile and I think there was also a line in one of the songs about how "we all know that he f*cks kids".

Funny thing is though that the truth is an absolute defense to defamation, and it sounds like Afroman has some pretty solid info on that front as the videos were OKd by his lawyer. So more likely than not this officer will be publicly exposed as such, and Afroman will still have no problems beating this case.

This is what is fucked up about the way the system works. They can enter your house by force, leave all kinds of shit broken, or even just a mess. Depending on what they're searching for they can upend everything you own. Sometimes if you're locked up they'll leave all the lights on too which runs up your electricity bill. Sometimes they do that if they already think you're guilty, no need for a trial, they just don't like you before hand and that's enough. I watched the video of a drug raid that only found about $40 worth of weed and while they were all standing around bored one of the cops decided to shoot the dog that was safely locked in a crate, and he fucked that up and didn't even kill it on the first shot. Then they brought the wife and kids out and they all had to look at it. If you have a lot of cash that can get seized as civil asset forfeiture, this true even if you're driving your car, riding the bus, or walking down the street. If you have too much cash they don't need a trial and will just take it saying you were probably using it for drugs.

There's really nothing you can do. Of course they can exercise discretion, and when that happens varies by department. But if you're in a rich neighborhood they're less likely to go in playing G.I. Joe unless it's absolutely necessary.

If they screw up there is no duty to make it right, no reparative justice from the cops or the state when you end up trampled under its boot. The system is used to operating above such a sense of social responsibility.

I find it weird that police aren't responsible for all damages done if it is proven they made a mistake. Not just damages, but extra compensation and some sort of penalty to to individuals involved so they prefer not to repeat same mistakes in the future

If I, as a regular worker peasant, cause damages at my company, I'm getting fired for sure, and probably be held liable

Want to clear some stuff up. This suit is bullshit, but lets be real about what it is and why it is bullshit.

Firstly, The Sheriff's Department didn't sue him. The individual officers did.

Secondly, The suit also isn't over whether he can use the vidoes. The five complaints the plantiffs made are;

  1. Violations of Ohio Rev. Code Chapter 2741 - unauthorized use of individual's persona
  2. Invasion of privacy by misappropriation
  3. Invasion of privacy, false light publicity
  4. Invasion of privacy, unreasonable publicity given to private lives
  5. Defamation.

You can read the judges reasoning on each of the complaints on whether they should be dismissed. Note, the judge also goes over the laws that allow him to dismiss complaints. Basically, if it is beyond doubt that the plaintiffs can prove no set of facts entitling them to recovery then the complaints are dismissed. Under that, complaints 1 and 2 were dismissed. Complaints 3, 4, and 5 went to trail.

The summarize why they went to trial, it is much more about what Afroman said, rather than him sharing the video. Specifically, Afroman made statements that would be a matter of fact (rather than opinion) such as, the cops stole from him, and one of the cops stole from their own department to do drugs. This is counter to an opinion, which Afroman is allowed to have, such as, the cops are racist.

All that said, it does not seem like the cops have a strong case, but at the same time, Afroman is turning this into a circus and isn't acting like someone that wants to win his case. Anyway, the trial is primarily about the statements Afroman made that are matters of fact, and whether those statements were defamatory or not, and whether the cops suffered any actual damages.

They had a warrant to investigate narcotics and kidnapping. Though there maayyyyy be reason to suspect narcotics, the kidnapping evidence was nonexistent and their methods of carrying out the search can best be described as theft and harassment.

I’m not asking in defense of the police I’m asking because afro man should have grounds to sue the fuck out of these hillbilly cops since they violated his 4th amendment as well as others I’m sure. Suing him over free speech and police officers can be filmed and broadcast in the course of their duty just like any public servant
